1. These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded by their own terms and conditions), and Visit Prosecco Italy, the owner and operator of this Website.

2. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

3. In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Visit Prosecco Italy and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Visit Prosecco Italy and accessing the Website in connection with the provision of such services.

4. You must be at least 18 years of age to use this Website or, if you are under 18 years of age, you have the consent of your parent or guardian to use this website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age or, if you are under 18 years of age, you have the consent of your parent or guardian.

Legal relationship: Users, Suppliers and the Website

5. The Website provides information on visiting the Prosecco region of Italy, including links to vineyards, accommodation, restaurant and product suggestions.

6. The Website also allows Users to book directly with individuals or companies (Suppliers) who provide tourism services such as driving (Services) in Italy.

7. The information on the Website is for general information purposes only and does not constitute an offer binding on Visit Prosecco Italy.

8. Contracts for the Services are to be concluded directly between the Users and the Suppliers.

9. Visit Prosecco Italy is not a contracting party with regards to any Services referenced or on the Website or agreed to by the Suppliers.

10. When you purchase goods such as Prosecco Delivery, the resulting legal contract is between you and the Winery and such contract shall comprise of these Terms and Conditions, the email confirmation of your order and the applicable details on the product page and you agree to be bound by all such provisions.

Tour Booking Terms

11. As the contract for Services is between the User and the Supplier, these Terms and Conditions apply to the User’s use of the Website for booking the Supplier’s Services only.

Booking process and conclusion of contract

12. The Website displays the Services offered by the Suppliers. The user can, after checking availability, make a contractual offer for the Services, by placing an offer, to be sent to the respective Suppliers. This happens by clicking on the booking button on the Website or on Visit Prosecco Italy’s social media pages.

13. The User is bound to their binding offer for five working days or until their selected tour date, whichever is sooner.

14. Visit Prosecco Italy shall provide the User with a booking request confirmation email which will include the name of the Supplier (e.g. the driver’s name), as well as a payment confirmation.

15. Visit Prosecco Italy shall transfer data between the User and the Supplier for the purpose of the contracting and provision of the Services.

16. It is the Supplier’s responsibility to reply to the User with full details of the Services (e.g. pick up time, meeting point, terms and conditions) and the contract is not concluded until this email is received by the User and full details of the Services are agreed between the User and the Supplier.

17. Visit Prosecco Italy offers no guarantee for the accuracy of forwarded data, or for the performance of the Services by the Supplier, as all the information indicated and forwarded is based on data from Suppliers, which Visit Prosecco Italy cannot check in detail.

18. It is the Supplier’s responsibility to notify the User of the terms and conditions applicable to the provision of the Supplier’s Services.

Pricing on the Website

19. All prices on the Website includes relevant UK taxes.

20. Prices specified may be subjected to special conditions, for example with regards to extra services, cancellation and the refunding of payments made. Before conclusion of the contract, please check precisely whether the respective service agreement is subject to separate conditions.

Payments on the Website

21. Visit Prosecco Italy is permitted to collect the invoiced amounts (or a percentage of the amount) in the name of, and on behalf of the Supplier.

22. As the contact for the Services is between the Supplier, the User can only assert repayment of a payment from the Supplier. A refund granted by the Supplier can also be processed by Visit Prosecco Italy.

23. Any deposit paid shall not be refundable.

24. The User will be notified of the payment methods permitted for the Service during the booking process.

25. Upon authorization of the payment, the User consents to their payment information being used for the collection of payments by Visit Prosecco Italy or by a third-party intermediary (e.g. a payment gateway such as Stripe) used by Visit Prosecco Italy.

Services availability and warranty

26. The User shall have no claim against Visit Prosecco Italy for availability, quality or service features.

27. Visit Prosecco Italy makes no guarantee or warranty about the services provided by Suppliers.

28. The User should contact the Supplier in the event of questions or claims about the Services, the service agreement and its execution.

Website Terms

Intellectual property and acceptable use

29. All Content included on the Website, unless uploaded by Users, is the property of Visit Prosecco Italy, our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission

30. You may, for your own personal, non-commercial use only, do the following:

68. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
